Please check that your computer is suitable before purchase (PC with Windows 98 or later but not AppleMac) as it is not normal practice to make refunds on CD's after delivery. Any exchange of discs which may be faulty at the time of purchase is at the discretion of Dave Titchmarsh and should be negotiated before return.

When you purchase 'North York Moor Tour', you agree to the terms of use outlined below. For legal purposes, the disc is designed for use in the United Kingdom and Dave Titchmarsh accepts no responsibility for use elsewhere.

Note: This version of 'North York Moor Tour' is NOT LICENSED for use in SCHOOLS, CLUBS or BUSINESS PREMISES. Non-profit/educational use requires a site license in advance (see below). All forms of BUSINESS USE must be negotiated in advance.

THE CONTENTS OF THE DISC ARE PROTECTED BY COPYRIGHT LAWS AND INTERNATIONAL COPYRIGHT TREATIES, AS WELL AS OTHER INTELLECTUAL PROPERTY LAWS AND TREATIES. UNAUTHORIZED REPRODUCTION OR DISTRIBUTION OF THE CONTENTS, IN WHOLE OR PART, MAY RESULT IN SEVERE CIVIL AND CRIMINAL PENALTIES, AND MAY BE PROSECUTED TO THE MAXIMUM EXTENT PERMISSIBLE UNDER LAW. THE PRODUCT IS LICENSED, NOT SOLD.
LICENCE. This Licence Agreement permits you to use one copy of 'North York Moor Tour' on a single computer. 'North York Moor Tour' is "in use" on a computer when it is loaded into the temporary memory (i.e. RAM) or installed into permanent memory (e.g. hard disk, CD-ROM drive or other storage device) of that computer. You may not use 'North York Moor Tour' on or over a network or any other information transfer system without each user having an original copy of the Software and its documentation (A SITE LICENCE CAN BE OBTAINED FOR MULTIPLE USE). This license is not transferable to any other system, or to another organization or individual.

YOU MAY USE THE DISC AT VARIOUS TIMES IN DIFFERENT COMPUTERS SO LONG AS NO PART HAS BEEN COPIED TO ANY OTHER HARD DRIVE OR ANY OTHER STORAGE DEVICE.
COPYRIGHT. All intellectual property rights in the 'North York Moor Tour' (including all images and text incorporated into the Software) are owned by Dave Titchmarsh, and are protected by UK/English copyright laws and international treaty provisions. You must treat 'North York Moor Tour' like any other copyrighted material, except that you may transfer the Software to a single hard disk provided you keep the original solely for backup or archival purposes. You may not distribute copies of any text/images in electronic, print or any other format. You may not broadcast/display text/images from 'North York Moor Tour' in any public place or on business premises. You may not loan, rent or lease the Product, but you may transfer your rights under this Agreement on a permanent basis provided you transfer the license granted by this Agreement, the Software and all associated printed materials and retain no copies, and the recipient agrees to the terms of this Agreement. You may not reverse engineer, de-compile or disassemble 'North York Moor Tour', except to the extent that this restriction is expressly prohibited by applicable law.
You should seek permission IN ADVANCE for any use of 'North York Moor Tour' which might infringe copyright. Any such request will be treated on merit. Permission will not be granted in retrospect.
'North York Moor Tour' is supplied AS IT IS. There is no guarantee that it is error free, that the information contained is correct, or that it will function on any specific computer system. Dave Titchmarsh does not accept liability for damage to or loss of data from any computer system resulting from the installation and/or use of 'North York Moor Tour'.
In the event that part of this licence agreement becomes invalidated by law, all other parts remain valid.

Schools and Clubs should not purchase a single disc version, but apply for a site licence, for permission to run multiple copies and have limited rights to display and copying. For clubs and small Primary Schools (to 150 pupils) the cost is £10, for larger Primary Schools £15 and Secondary Schools £20.

All business use of North York Moor Tour should be negotiated IN ADVANCE on its merits.

Please discuss any use of North York Moor Tour which might infringe copyright in advance. Permission will often be granted for reasonable non-profit making purposes. Permission will not be granted in retrospect.
